Expert Legal Services for Sotogrande Property Owners

Do I need a local lawyer in Sotogrande?

Yes — an independent Spanish lawyer acting only for you. From our Algeciras office we reach Sotogrande in about 20 minutes, in person when it counts, and on our 24/7 line in English or Spanish. In a 30-minute call you will know exactly what you need and how long it takes.

Most of our Sotogrande clients come to us in July or August — when they finally have time to deal with the things they have been putting off. The Spanish will they meant to sort three summers ago. The inheritance plan they have not looked at since Brexit changed everything. The wealth-tax bill they are not sure they should be paying.

If any of that sounds familiar, you are in the right place. We are Costaluz Lawyers, based in Algeciras — about 20 minutes from your door — advising international owners on this coast since 2006.

Three things Sotogrande owners should settle in 2026

Your Spanish will — before it becomes your family’s problem

Without a Spanish will, your Sotogrande property does not simply pass to your spouse or children the way your home-country will intends. Spanish forced-heirship rules (la legítima) can apply, and your family may spend months resolving it in a court system they do not understand. A Spanish will can elect your own national law (Brussels IV) and sit alongside your existing one. Andalucía also gives close family a 99% inheritance-tax reduction and a €1,000,000 allowance per heir — but the planning has to be in place before it is needed. See coordinating a Spanish will and the inheritance process.

Wealth tax — money you may be owed back

In rulings of 29 October and 3 November 2025, Spain’s Supreme Court extended to non-residents the combined income-and-wealth-tax limit (the 60% ‘fiscal shield’ of Article 31) that residents already enjoy, on EU free-movement-of-capital grounds. For many non-resident owners that opens a refund of wealth tax — and of the Solidarity Tax on Large Fortunes, which applies to Spanish assets above €3,000,000 — paid under the old rules. There is a limited window to claim. We will tell you in a 30-minute call exactly where you stand. See our wealth-tax refund guide.

Gibraltar ties — a date that matters

The EU–UK treaty on Gibraltar has been provisionally applied since 15 July 2026. If you have financial ties to Gibraltar — accounts, employment, company structures — the cross-border tax position changes from that date. As an Algeciras firm in the heart of the Campo de Gibraltar, we deal with both Spanish and Gibraltar-adjacent property structures every day.

Why owners trust Costaluz with their Sotogrande affairs

The facts, not a sales pitch. Costaluz Lawyers has acted in more than 620 deposit-recovery cases and recovered over €31 million for international buyers since 2012, and has advised on Spanish property, inheritance and tax since 2006.

María Luisa de Castro is registered with the Colegio de Abogados de Cádiz (nº 2745), speaks fluent English, and has acted for clients from more than 25 countries. She will be the lawyer on your file — not a junior associate. Flat fees, buyer- and owner-side only, in English and Spanish.

We know Sotogrande — not just “the area”

We act for owners across La Reserva de Sotogrande, Puerto Sotogrande (the marina), the Kings & Queens streets, Sotogrande Costa and the San Roque Club area, and neighbouring Alcaidesa. If your home is in one of these, the issues below are not hypothetical — they are what we handle for your neighbours every summer.

A scenario we see every season

A villa in La Reserva. Two British owners, no Spanish will, no non-resident wealth-tax filing. One owner dies. What happens to the surviving spouse? To the children? What is owed, and within how many days? It is solvable — but only if the groundwork (a Spanish will electing your national law, a clean tax position) is in place before it happens, not after.

If you let your Sotogrande property short-term

In a 2026 ruling (STS 620/2026) the Supreme Court annulled the State’s national single registry for short-term rentals, holding the State lacked the competence to create it. The autonomous-community rules and the digital single-window still apply, so your obligations have changed, not disappeared. If you rent out your property, ask us what it now means for your registration and tax position.

Frequently asked questions — legal services in Sotogrande

Do I really need a Spanish lawyer if I already have a UK solicitor?

Yes. Your home-country solicitor cannot act on Spanish title, Spanish tax filings or a Spanish will. We work alongside them so nothing falls between two systems.

I only spend the summer here — can you still help?

Most of our clients are non-resident or part-year owners. We work by email, video and our 24/7 EN/ES line, and meet you in person while you are in Sotogrande.

What happens on the 30-minute review call?

You tell us what you need — a will, an inheritance, a tax question, a purchase. We tell you what to do, how long it takes and what happens next. No obligation, no vague answers.

Does Costaluz act for the buyer or the seller?

The buyer or the owner — never the developer or agent on the same matter. Independence is the point.
