1. Terms of Use:

These provisions regulate the use of the Internet portal service (hereinafter referred to as the ‘website’) that MONTOUR DRIVE S.L.P.U (hereinafter referred to as Montour Drive) makes available to Internet users.

Access to the website is free of charge except for the cost of the connection through the telecommunications network provided by the access provider contracted by users. Certain services are exclusive to our clients and access to these is restricted. The legal or tax services provided by the Firm are generally priced according to the corresponding professional services proposal and are not offered or provided through the Website service.

The use of the Website grants the condition of user of the Website (hereinafter referred to as the ‘User’) and implies the acceptance of all the conditions included in this Legal Notice. The provision of the Website service is limited to the time when the User is connected to the Website or to any of the services provided through it. Therefore, the User must carefully read this Legal Notice on each occasion they intend to use the Portal, as both this and its terms of use included in the present Legal Notice may be subject to modifications.

Some services of the Website accessible to Internet users or exclusive to Montour Drive clients may be subject to particular conditions, regulations, and instructions which, as appropriate, replace, supplement, and/or modify this Legal Notice and must be accepted by the User prior to the commencement of the relevant service.

2. Intellectual and Industrial Property

All contents of the website, by way of example but not limited to, the texts, photographs, graphics, images, icons, technology, software, links, and other audiovisual or sound content, as well as its graphic design and source codes (hereinafter referred to as the ‘Contents’), are the intellectual property of Montour Drive or third parties, without any of the rights of exploitation recognised by the current regulations on intellectual property being transferred to the User, except those that are strictly necessary for the use of the Website.

The trademarks, trade names, or distinctive signs are owned by Montour Drive or third parties, and it cannot be understood that access to the Portal grants any right over the aforementioned trademarks, trade names, and/or distinctive signs.

3. Terms of Use of the Portal

3.1 General

The User is obliged to use the Website correctly in accordance with the Law and this Legal Notice. The User shall be liable to Montour Drive or third parties for any damages that may be caused as a result of a breach of this obligation.

The use of the Website for purposes harmful to the property or interests of Montour Drive or third parties, or that in any other way overloads, damages, or disables the networks, servers, and other computer equipment (hardware) or computer products and applications (software) of Montour Drive or third parties, is expressly prohibited.

3.2 Content

The User agrees to use the Content in accordance with the Law and this Legal Notice, as well as with other conditions, regulations, and instructions that may be applicable in accordance with the provisions of clause 1. By way of example but not limited to, in accordance with current legislation, the User must refrain from:

a) Reproducing, copying, distributing, making available, publicly communicating, transforming, or modifying the Content except in cases authorised by law or expressly consented to by Montour Drive or by the holder of the exploitation rights.

b) Reproducing or copying for private use Content that may be considered software or a database under current intellectual property law, as well as its public communication or making it available to third parties when such acts necessarily involve reproduction by the User or a third party.

c) Extracting and/or reusing all or a substantial part of the Content of the Website, as well as the databases that Montour Drive makes available to Users.

4. Privacy Policy: Data Protection

Without prejudice to what is established in this Legal Notice, as well as in the privacy policies accessible from the Website and applicable at any time, the use of certain services or requests addressed to Montour Drive are subject to the prior completion of the corresponding User registration.

All information provided by the User through the Website forms for these purposes or any others must be truthful. In this regard, the User guarantees the authenticity of all data provided and will keep the information provided to Montour Drive fully updated so that it corresponds, at all times, to the User’s actual situation. In any case, the User shall be solely responsible for any false or inaccurate statements made and for any damage caused to Montour Drive or third parties by the information provided.

4.1. Necessary and Updated Information

All fields marked with an asterisk (*) in the Website forms are mandatory, so omitting any of them could result in the inability to provide the requested services or information.

You must provide truthful information so that the information provided is always up-to-date and free from errors. You must notify the Company of any modifications or corrections to your personal data as soon as possible via email to web@costaluzlawyers.es

Likewise, by clicking the “I Accept” (or equivalent) button incorporated in these forms, you declare that the information and data provided are accurate and truthful.

4.2. General Information: Description of the Information in the Privacy Policy

In this privacy policy, you will find a table identifying, for each of the different data processing activities carried out by the Company, the following information:

• The purposes for processing your personal data, i.e., the reason why the Company processes your personal data.
• The legal bases that allow the Company to process your data for each of the indicated purposes.
• The possible communication of your data to third parties, as well as the reason for such communication. To this effect, we inform you that we do not transfer your personal data to third parties unless there is a legal obligation. 4.3. Exercising Your Rights

If you believe that we have not properly processed your personal data, you can contact the Data Protection Officer at web@costaluzlawyers.es. Additionally, you have the right to file a complaint with the Spanish Data Protection Agency if you believe that a breach of data protection legislation has occurred with regard to the processing of your personal data.

4.4. Cookies

Montour Drive will only use storage and retrieval devices (‘Cookies’) when the user has given prior consent, in accordance with what is indicated in the pop-up window of the user’s browser when accessing the Website for the first time and under the terms and conditions outlined in Montour Drive’s Cookie Policy, which all users must be aware of.

4.5. Security Measures

Montour Drive adopts the security measures required by the GDPR appropriate to the nature of the data being processed at any given time. However, technical security on the Internet is not invulnerable, and there may be malicious actions by third parties, although Montour Drive will take all reasonable measures to prevent such actions.
