The essentials (short version)

• Jurisdiction: Spanish family law generally applies when Spain is the place of habitual residence. EU regulations cover divorce, maintenance, and matrimonial property regimes.
• Marriage: Civil and religious marriages are both recognised. The default regime is community of assets (except in regions like Catalonia or the Balearics, where separation of assets applies). You can choose or change your regime before a notary at any time.
• Divorce: No need to prove fault or give reasons. Mutual agreement divorces are faster, more predictable, and kinder. We draft and manage out-of-court settlements, including division of property, parental plans, and notarial formalisation.
• Children: Shared custody is increasingly common. Judges — and we, in our agreements — always prioritise the best interests of the child. Child maintenance depends on real income and the child’s needs.

1. Neutral assessment: identify each party’s interests and non-negotiables.
2. Mediation phase: explore practical, sustainable solutions (custody schedules, home use, financial arrangements).
3. Settlement drafting: prepare a clear Regulatory Agreement or Parenting Plan covering contact, holidays, relocations, and communication.
4. Financial terms: define housing use, asset division (community or separate), compensatory or maintenance payments.
5. Formalisation: sign before a Spanish Notary, with bilingual versions if needed, and coordinate official registration if required.
