Can you buy property in Spain without being there? Yes — with a notarial power of attorney (poder notarial), signed before a notary in your own country (with an Apostille and sworn translation) or at a Spanish consulate. The mistake to avoid is a power of attorney that is too narrow or too wide. Too narrow and your representative cannot do a necessary step (open a bank account, sign the mortgage); too wide and you have granted more authority than you intended. A property-purchase POA should be drafted by your lawyer for exactly the transaction in hand.

How a power of attorney works for a Spanish purchase

  1. Drafting. Your lawyer prepares the POA text listing the specific acts authorised — obtain the NIE, open a bank account, sign the deposit contract and the escritura, pay taxes, register the property, set up utilities.
  2. Signing abroad. You sign before a local notary; the document is legalised with the Hague Apostille and accompanied by a sworn (juramentada) translation into Spanish. Alternatively you sign a POA directly at a Spanish consulate, already in Spanish.
  3. Use in Spain. Your lawyer presents the POA at the Spanish notary and Land Registry and acts for you through completion.
  4. Scope and revocation. The POA can be limited to one purchase and revoked at any time before a notary; a well-drafted one expires or is revoked once the transaction is done.
