If you inherit property or assets in Castilla y León, Spain, you will need to consider three essential aspects: taxation, wills, and the probate process. This guide provides a clear summary for expats and residents.
1. Inheritance and Gift Tax in Castilla y León
Castilla y León applies a very favourable regime for close relatives, combining a base reduction with a 99% bonificación on the tax due.
- Children, spouses and parents (Groups I and II) benefit from a 99% bonificación on the inheritance tax due, on top of a €60,000 base reduction per heir — in practice this makes inheritances up to around €400,000 effectively tax-free.
- Additional reductions may apply for disability, family businesses, or the family home.
- Gifts (donations) between parents and children can also benefit from reductions if executed before a notary.
Examples:
- A son inheriting €350,000 → effectively pays nothing, as the €60,000 reduction plus the 99% bonificación cover inheritances around this level.
- A daughter inheriting €500,000 → after the €60,000 reduction and the 99% bonificación, pays only about 1% of the standard tax (a few hundred euros).
2. Making a Will in Castilla y León
- Foreigners with property or assets in Castilla y León are strongly advised to make a Spanish will.
- Thanks to EU Regulation 650/2012, you may choose your national law to apply to your inheritance.
- A Spanish will prevents conflicts, reduces paperwork, and accelerates the probate process.
- The will is signed before a Spanish notary and recorded in the Central Registry of Wills.
3. Executing an Inheritance in Castilla y León (Probate Process)
The inheritance process in Castilla y León usually involves the following steps:
- Death certificate of the deceased.
- Certificate of last will (Certificado de Últimas Voluntades).
- Inventory of assets (real estate, bank accounts, vehicles, investments).
- Inheritance deed signed at a notary (escritura de aceptación de herencia).
- Inheritance tax declaration within 6 months (extensions may be requested).
- Registration of property in the Land Registry if real estate is inherited.
Average timeframe: 3–6 months, depending on documentation and family agreements.
