1. Inheritance and Gift Tax in Navarra
Navarra has its own independent inheritance tax system, separate from the rest of Spain.
- Spouses and registered partners pay 0% on the first €250,000 and just 0.8% above that. Children and other direct descendants/ascendants are taxed on a progressive scale of 2%–16%, after a reduction of €100,000 (€125,000 if under 21).
- Siblings are taxed at a flat 0.8%; more distant relatives and unrelated heirs pay higher rates (up to 34%).
- Navarra sets its own rates and reductions under its foral (regional) system, separate from Spain’s state rules.
For gifts (donations): parents may transfer assets to children with significant reductions, provided the transfer is notarized.
Examples:
- A spouse inheriting €200,000 → pays nothing, within the €250,000 0% band for spouses.
- A daughter (over 21) inheriting €400,000 → after the €100,000 reduction, the remaining €300,000 is taxed on the 2%–16% progressive scale.
2. Making a Will in Navarra

- A Spanish will avoids unnecessary complications and accelerates the probate process.
- Wills are signed before a Spanish notary and registered in the Central Registry of Wills.
3. Executing an Inheritance in Navarra (Probate Process)
The inheritance process usually involves:
- Obtain the death certificate.
- Request the certificate of last will (Certificado de Últimas Voluntades).
- Gather details of assets (bank accounts, real estate, investments, vehicles).
- Inheritance deed signed before a notary (escritura de aceptación de herencia).
- Inheritance tax declaration within 6 months (extensions possible).
- Update the Land Registry if real estate is inherited.
Average timeframe: 3–6 months, depending on documentation and family agreement.
