Plusvalía Municipal (Municipal Capital Gains Tax) — Plusvalía Municipal (formally, Impuesto sobre el Incremento de Valor de los Terrenos de Naturaleza Urbana) is a municipal tax levied on the theoretical increase in the value of urban land when a property changes hands — whether through sale, inheritance, or donation. It is paid to the local Ayuntamiento.

This tax has a complicated history. In 2021, Spain’s Constitutional Court struck down the previous calculation method as unconstitutional because it taxed people even when land values had actually decreased. Since then, a reformed system offers two calculation methods, and the taxpayer can choose whichever results in a lower bill. Method 2 (Real): Based on the actual gain — the difference between the acquisition price and the sale price, applied proportionally to the land element. You can choose the method that gives you the lower tax bill.
