Madrid’s expanded Inheritance and Gift Tax relief has been in force since 1 July 2025, following final approval by the Madrid Assembly on 12 June 2025. It is no longer a proposal: it is the relief that applies to estates and gifts in the region today. It made Madrid the first Spanish autonomous community to extend a 50 % exemption to siblings, uncles, aunts, nephews, nieces, and the entire Group III of relatives—beyond the traditional beneficiaries in Groups I and II (parents, children, spouses)

Important: Spanish succession follows two distinct paths depending on whether the deceased left a valid will (testate) or not (intestate). The intestate path requires a Declaration of Intestate Heirs (Declaración de Herederos Abintestato) — a step not needed when a will exists. Learn more about the succession process →

  • From 25 % to 50 % exemption for transfers between siblings, uncles/aunts and nephews/nieces, and all other Group III relatives.

  • Despite lower rates, the region’s revenue continues to climb: in 2022, Madrid’s share of Personal Income Tax (IRPF) grew by 7.2 %, adding €897 million to total receipts of €13.392 billion
